2021 PebbleGo Going Places Award Contest
CONTEST DESCRIPTION: PebbleGo by Capstone is conducting a contest (the “Contest”) to see who can submit the best testimonial about how PebbleGo has been helpful to educators and students over the last year. The Contest begins at 12:01 a.m. Central Time on April 11, 2021 and ends at 11:59 p.m. Central Time on May 9, 2021. Entries will not be accepted after 11:59 p.m. Central Time on May 9, 2021. Entry in the Contest does not constitute entry into any other promotion, contest, or sweepstakes of Capstone.
ELIGIBILITY: Any person over the age of 18 years, employed by a school in the United States may submit an entry. Only one entry per person will be accepted, but any number of people employed by a school may submit an entry. A person who is also an employee of Capstone or who is an immediate family member (parent, sibling, spouse, or child) of an employee of Capstone or any of its subsidiaries is not eligible to enter.
HOW TO ENTER: Submit a video of yourself, in .mp4 or .mov format, not shorter than 1 minute or longer than 2 minutes, of your testimonial for how PebbleGo has been helpful to educators and students over the last year. Entries must be submitted to Flipgrid via the following URL: https://flipgrid.com/d16cfc12 OR sent by email to: firstname.lastname@example.org, and must be received by 11:59 p.m. Central Time on May 9, 2021. The video must be taken by you (i.e., a “selfie”) and not by anyone else, and must not include any person other than yourself. Each entry must include your name and email address and the name, mailing address, and email address of the school at which you are employed. Any entry that does not meet these requirements will not be accepted. Capstone is not responsible for incomplete entries, for incorrect information submitted with an entry, or for entries that are undeliverable, misdirected, lost, or incapable of being viewed by Capstone.
ACCEPTANCE OF RULES: By entering the Contest, you agree to these Official Rules, and you acknowledge that you meet the eligibility requirements and agree that all decisions by Capstone in connection with the Contest and the selection of the winning entry will be final and binding.
SELECTION OF WINNER: The winning entry will be selected by a committee consisting of 4 Capstone employees who are directly involved in the development, production, and marketing of PebbleGo (the “Selection Committee”). Selection of the winning entry will be based on how well the individual entering the contest articulated how PebbleGo had helped them, other educators, and students over the last year. The Selection Committee will select the winning entry within thirty (30) days after May 9, 2021.
PRIZE: The prize is one (1) of three (3) free one-year subscriptions to Capstone Connect for the school chosen by the person submitting the winning entry. There are no substitutions and the prize is not transferable. Any sales, use, or other tax due as a result of receiving the prize will be the responsibility of the school receiving the prize. The free one-year subscription will begin at a date determined between the school receiving the prize and Capstone.
NOTIFICATION AND ACCEPTANCE: The winning person and school will be notified by email, using the contact information provided with the winning entry. Capstone will not be responsible for any incorrect notification addresses submitted with an entry or for any winner notification that is lost, intercepted, not delivered or not received for any reason. If the school at which the teacher with the winning entry is employed does not acknowledge receipt of notification of winning within fifteen (15) days after notification has been sent, or if the school is determined by Capstone to be ineligible, is disqualified or declines the prize, the Selection Committee will review the remaining entries and select a substitute winner, and the substitute winner and the substitute winner’s school will be notified as provided herein.
USE OF INFORMATION: By entering the Contest, you grant Capstone a nonexclusive, royalty-free, irrevocable license to reproduce, distribute, display, perform, and otherwise use your video, including your testimonial and your image and likeness contained therein, together with your name and any other personally identifying information submitted by you, for and in connection with public announcements and advertisements relating to the Contest and to PebbleGo, and you irrevocably and unconditionally release Capstone, its related entities and their respective employees, officers, directors, owners, agents, marketing partners and affiliates from any claims and actions of any kind arising out of any such use, including, without limitation, any claims or actions for copyright infringement, defamation or infringement of any right of privacy, publicity or confidentiality. If you are a resident of Tennessee, the foregoing grant of a license to use your name, image, likeness, and other personally identifying information and the waiver of claims or actions for infringement of any right of privacy or publicity does not apply to you.
SUSPENSION OR TERMINATION: Capstone is not responsible for any condition or unexpected event which may affect the operation or administration of the Contest or the fairness or integrity of the Contest, including, without limitation, computer hacking, loss of communication connections, civil unrest, war, pandemic, or government order. Capstone reserves the right, at its sole discretion and without notice to entrants, to revise, suspend or cancel the Contest in the event of any such condition or event.
GOVERNING LAW/JURISDICTION/VENUE: All issues and questions related to the construction, validity, interpretation, and enforcement of the Official Rules or the rights and obligations of entrants and Capstone in connection with the Contest will be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to its choice of law or conflict of law rules, or any provision that would cause the application of the laws of any other state. A determination that any provision of the Official Rules is invalid or unenforceable shall not affect the validity or enforceability of any other provision, and the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
